Backflow restrictor

I am installing this on a new construction home. My plumber states that this unit does not have a backflow restrictor and thus the valve assembly cannot be used, only the head and hand held. He says that when the inspector comes it will not pass the temperature test.
Can you confirm if this unit has a backflow restrictor?

What generates the voltage for the led shower lights? I see no wires or battery in the kit.

I purchased the sink faucet, and the shower kit, the sink faucet does have a battery pack and wire, however the shower kit does not have any visable power source or wires. Did I receive the correct shower faucet?
