Até aí nenhuma novidade, uma vez que essa é a lei conhecida e aplicada nesses casos.
Entretanto, chamo a atenção para o Decreto-Lei 1.804, de 3 de setembro de 1980, que trata sobre o regime de tributação simplificada das remessas postais internacionais. Em seu artigo 2o. inciso II, está escrita a seguinte informação: “Dispor sobre a isenção do imposto de importação dos bens contidos em remessas de valor até cem dólares norte-americanos ou o equivalente em outras moedas, quando destinados a pessoas físicas”.
Ou seja, uma instrução normativa e uma portaria não podem se sobrepor a um Decreto-Lei, devendo ser, portanto desconsideradas. A isenção de imposto se aplica a compras feitas por pessoas físicas, não importando se o remetente é pessoa física ou jurídica. Para quem ainda ficou em dúvidas, o site levantou que há jurisprudência sobre o tema, ou seja, já há decisões da justiça dando parecer favorável ao que se lê no Decreto-Lei 1.804.
